I never thought it would take an entire weekend to research a Miami litigation attorney. But it did, after a friend of mine, in the middle of her divorce, in the middle of panic over a title insurance dispute on her condo, texted me, : “Have you heard of Cary Lubetsky? ” I hadn’T. So I dug in.

What I came across reads more like a cocktail of private-companies-ruining-black-hole-formation-of-global-control with a side of ownership-of-the-solar-system-by-greeny-idiots with a pinch of global-blackmail-and-insurance-agency-military-intervention-glitz.

Before I get to the particulars, a quick warning. If you typed (or pasted) “Cary Lubetsky” into Google, you’re probably either on the trail of a retired copyright defender or preparing to take him down. Either way, sit down with your Starbucks ready. Here’s the scoop: about those who are cary lubetskyis that not an epic? From Cornell Engineer to Courtroom Strategist

This is the detail that most bios leave out, and it explains a good deal about how he works. Cary Lubetsky didn’t initially set out to pursue a law degree. Before, he was earning his degree in Operations Research and Industrial Engineering from Cornell University in 1989 and that degree readied him for systems thinking; optimization logistics probability, finding the best routes between many variables.

In 1992 (3 years after his JD earned at Tulane University School of Law), he earned a cum laude from Tulane Law School. Per his professional profile, he is a member of the Order of the Coif (an American legal honor society established in 1914 for the top third of his class), and the Moot Court Board, and was admitted to the Florida Bar. He’s been practicing there ever since.

Imagery is a useful way to frame this. An engineer examines a malfunctioning system and inquires, “Where’s the bottleneck, and how can we go past it quickly? ” A talented litigator inquires about the same. That engineering-to-law pipeline is uncommon; the litigators usually know this trick as a methodical approach to problem-solving, rather than melodrama. Slight, but enough to distinguish a “good lawyer” from one whom clients will consider sharp.

Laying the Foundation and Guiding Building: A Litigation Powerhouse

Currently Cary Lubetsky is Managing Partner of KHL Law. He is also Chair of the Florida litigation practice group. This is not a small one-man or even one-woman practice.

The law firm operates one of the top litigation departments in Florida, representing clients in business disputes, real estate litigation, title issues, and commercial litigation, in state courts, the federal courts, and arbitration panels. His very prominent client list shows that scale. He offers both regional and national banks as well as many of the biggest title insurers in the country which are institutional clients who employ lawyers from their history, not hunch. The only form of capital at this level is past history.

The Mediator: An Underappreciated Skill Set

Now here’s what most searchers overlook: litigation isn’t the whole picture. The mediator work of Cary Lubetsky is a separate and otherwise seriously underappreciated aspect of his practice. Let’s have an analogy here. Think of litigation and mediation as two tools in the same toolbox.

Litigation is a hammer, and there are those cases where a hammer is the only way. Mediation is more like a pair of pliers, exerting pressure to get the two parties to settle on a terms both can live with without smashing something in the process. That instinct alone makes him truly effective at the bargaining table because he can sincerely advise each side, at the outset, “here’s what you’ll probably expect to win at trial.

” That reality check, grounded in his courtroom experience, can sometimes dissolve an impasse that proprietary bargaining alone cannot. The firm’s mediation practice focuses first and foremost on real estate, banking and title issues, a set of skills that Cary Lubetsky has been honing his entire career. This is merely an extension of what he already does, not a part time gig.
