Between January 21st and January 25th, 2025, Capital One experienced a banking outage. This left thousands of customers unable to access their accounts, receive direct deposits, and complete electronic payments. The media coverage prompted a class action lawsuit to compensate customers for the restriction of access to customers’ money.

Within the context of Privacy & Cyber Law, the banking services disruption during the critical mid-month pay period left many Capital One customers unable to access direct deposits for daily expenditures and pay bills as they normally would. This disruption of their banking services caused immediate and mounting frustration that led to litigation.

Many of the impacted customers are continuing their pursuit for justice through the capital one account outage class action in hopes of receiving compensation and answers regarding the existence of a settlement and when it may occur.

What Happened During the Capital One Outage?

The disruptions of the Capital One Banking Services that began in mid-January 2025 compelled customers to file suit to seek legal remedies for the disruption of access to important banking services for several days as they are detailed in the legal documents.

The banking services disruption that started around January 16 and continued for 3 days impacted customers across the United States. During this period, customers reported that they could not:

  •  Access online banking accounts
  •  Receive direct deposits as expected
  •  Make electronic payments to complete transactions
  •  Process bill payments
  •  View accurate financial account information

Because the outage occurred during a common payroll period, many customers alleged that the disruption created immediate financial challenges.

The consequences of limited access to banking services during normal payroll periods are most apparent for the millions of Americans living paycheck to paycheck. People often rely on their salaries to pay rent, bills, and buy groceries.

A Class Action Lawsuit has been filed for the Capital One Outage

Legal action has begun.

On January 22, 2025, named plaintiff Daniel Zepeda filed a proposed class action lawsuit in Federal Court in Virginia. The lawsuit describes how Capital One does not provide reliable banking, and the outage made customers lose money.

The lawsuit wishes to represent those customers in the United States who lost access to their Capital One account or to their money.

The lawsuit describes how customers experienced negative effects such as:

  • Not being able to pay bills.
  • Not being able to receive money as a direct deposit.
  • Overdraft problems.
  • Not being able to access money that is important.
  • Financial problems and inconveniences.

The lawsuit also describes interruptions in banking as negligence and as a breach of contract.

Capital One has the right to defend themselves as the legal process is still ongoing.

Why This Lawsuit is Important

Unfortunately, banks having outages is a common occurrence. This case is especially important because of the scale and timing of the incident.

The modern customer has no choice but to rely on digital banking. Many households no longer go to a physical bank but rely on their digital banking to pay for everything. When a bank’s payment system is unavailable, it is more than a temporary inconvenience.

Imagine it being payday only to find out your direct deposit has failed. Imagine you have no access to your bank account and pay bills on credit. For a lot of people, this situation means financial insecurity.

The lawsuit claims the customers impacted by this situation should not have to deal with the repercussions of what the lawsuit states resulted from a banking system failure.

Is There a Capital One Outage Settlement?

The most asked question is if there is already a settlement.

According to the information available to the public, the interest the closure of the Capital One banking system is the subject of considerable litigation. Consumers should be careful not to associate this case with another Capital One settlement regarding the interest on savings accounts.

The two cases have nothing to do with each other.

The Settlement has nothing to do with the January 2025 Capital One Banking closure.
